Hiring A New Employee

New Jersey's Law Against Discrimination and numerous federal statutes prohibit discrimination in the hiring of employees. Employers and those interviewing new employees must be exceptionally careful in the interviewing process to avoid claims that their hiring process may be discriminatory. Besides the obvious discriminating questions like "How old are you?", employers should also be careful not to ask questions similar to those below.

  • What is your maiden name?
  • Where were you born?
  • What holidays do you observe?
  • Could you provide a photograph? (before hiring)
  • Do you speak other languages at home?
  • Are you in a National Guard Unit?
  • Are you a member of The Rotary, Elks or other fraternal organization?
  • What is your husband's occupation?
  • How tall are you, or what do you weigh? (unless specifically job-related)
  • Do you have any disabilities?
